Website Usage Istibyani, a 7awi group company, offers registered members the opportunity to participate in online surveys (hereinafter referred to as “Service”). These surveys are either directly commissioned by product manufacturers/ service suppliers themselves or commissioned by market research agencies (both hereinafter referred to as ("Commissioner(s)"). 7awi group, has no representation or warranty (either express or implied) as to the completeness of the information or its suitability for any particular purpose. Membership to Istibyani is open to any person who, at the time of registering for membership, is not less than 15 years of age and is a national of and resident in any of the following countries: Jordan, Palestine, Egypt, Saudi Arabia, UAE, Qatar, Oman, Bahrain, Kuwait, Algeria, Tunisia, Morocco, Libya, Yemen, Djibouti, Syria, Sudan and Iraq. Accordingly, you understand, recognize and agree that 7awi group and any of its affiliates and subsidiaries reserve the right, at any time to cancel the membership of any person who is not 15 years old and is not a national of and resident in any of the above mentioned countries, in addition to the right to disqualify any such member from participating in any draws or wining any prizes. Consequently, and in the event your membership is cancelled, you are disqualified from participating in any draws and/or you are found to be ineligible to receive a prize, not only do you agree to waive all rights, which you may but for this acknowledgement, have to litigate and/or seek an injunctive relief against 7awi group and any of its affiliates, subsidiaries and direct and ultimate shareholders, but you also agree to release and discharge 7awi group, its affiliates, subsidiaries and direct and ultimate shareholders from any and all liabilities, demands and losses arising out of or in connection with any such right. Only one registration per person is permitted. Duplicate accounts shall be deleted and all points shall be forfeited.Member Responsibilities
Members are solely responsible for the reporting and payment of any tax liabilities incurred in connection with use of this website, including without limitation registering as a member, participating in surveys, earning and redeeming points, participating in draws and/or winning prizes. Each member agrees not to provide false or misleading personal information, and, in particular, agrees not to register under a false identity. Each member is responsible for using the online information management system to immediately report all changes to the information he or she provided at registration.Participation in Surveys
Members who have signed up to participate in surveys (hereinafter "Participant(s)") may be sent survey invitations by e-mail or by logging into their Istibyani account. The Participant is free to choose whether or not to participate in a survey to which he or she has been invited. The Participant has no legal right to be invited by Istibyani, to participate in surveys. The Participant accepts the obligation to fill out the surveys accurately, and in particular, to not give any false or inappropriate answers. Surveys may contain filter questions to determine whether a Participant belongs to the target group for a given project, including being a national of and/or resident in a specific country. The survey will automatically end if, after these filter questions are answered, it is found out that the Participant does not belong to the requested target group. Similarly, the survey may end if a quota is reached for a particular target. Only partial points are given to Participants not fitting the target group or their quota cell is closed. Cancellation of participation is possible at all times and can be carried out in the "Unsubscribe" area. Furthermore, cancellation takes place automatically when the Istibyani membership is terminated for any reason whatsoever including pursuant to the “Termination” section set forth hereunder.Liability is Excluded
By accessing this Istibyani website members agree that 7awi group, shall not be liable for any loss and/or damages whatsoever that members may suffer in connection with any use of this website, and in particular, 7awi group shall not be liable for special, consequential or incidental damages or damages for loss of profits, loss of revenue, or loss of use, arising out of or in connection with this Istibyani website or the information or material contained therein, whether any claim is brought in contract, tort (including negligence), or otherwise. 7awi group assume no responsibility whatsoever for injuries, losses, or damages of any kind that result from acceptance, possession, or use of any Istibyani reward points, vouchers, donations, 'raffle' tickets or merchandise redeemed with Istibyani reward points. 7awi group shall not be responsible for lost or stolen vouchers, prizes or merchandise sent to Participants.Earning and Redeeming Istibyani Reward Points
The processes of earning and redeeming Istibyani reward points (“Reward Points”)is subject to regulations as outlined in section “Reward Rules” provided for, below. These rules form a part of the terms of use of this Istibyani website and are subject to our overriding rights to vary them from time to time and in whatever manner as we shall deem fit.Rewards Rules
The Participant will have a chance to win prizes and/or Istibyani Reward Points for a survey that has been filled out completely and truthfully and can be analyzed. The type and amount of this prize is normally specified in the invitation e-mail or on the Istibyani website. Points accumulated can be redeemed as Instant Prize, Buying Raffle Tickets and Participants might also enter into a prize draw, in case the invitation and/or the information in the site conveys it. Participants who wish to redeem their Reward Points might be required to have an account with a third party partner site. Upon redemption of the Reward Points, the Participants are responsible for providing Istibyani, with the correct Third Party Partner account number. The Reward Points selected for redemption will be automatically credited to the Third Party Partner account number provided by the Participant. 7awi group, shall not be responsible for any errors in the Third Party Partner account number that is provided by the Participant and shall also not be responsible for any loss of points resulting therefrom. Only one Third Party Partner account is permitted per Participant. Participants are responsible for making sure that the Third Party Partner account number is correct, and Third Party Partner numbers may be saved as an option in the redemption page and updated at any time through the update profile section of the Istibyani site. Points collected with Istibyani have utilized within 12 months from the date they were collected otherwise they will be canceled. Furthermore, Istibyani will be carrying out two types of prize draws:Survey completion draws:
These prize draws will be held at the end of each month and will include all the Participants from the previous month’s surveys. Participants who have participated in multiple surveys on that specific month will have multiple chances of winning based on the number of participations. The dates of the draw will be communicated separately within the e-mail invitations to participate in surveys. The dates can be changed at any time at Istibyani discretion. The draw will be held at the offices of 7awi group Jordan Office in Amman, Jordan. 7awi group Jordan Office. shall not in any way be liable towards any Participant in respect of any loss or damage that may be incurred thereby in relation to use of the Istibyani website, including without limitation, any damage or loss that may be sustained due to cancelation of the membership of the Participant, his disqualification from participating in any draws and/or such Participant being held to be ineligible to receive a prize. The prizes for each campaign will only be given to Participants who have completed the survey and have complied with these Terms and Conditions, including, without limitation, section “Membership of Istibyani” above. Moreover, all Participants not adhering to the terms and conditions of 7awi group will not be part of the draw and their account will be subject to deletion without any prior notice.Recruitment campaign draws:
These prize draws will be held at the end of the each recruitment campaign at the offices of 7awi group Jordan Office. 7awi group Jordan Office. shall not in any way be liable towards any Participant in respect of any loss or damage that may be incurred thereby in relation to use of the Istibyani website, including without limitation, any damage or loss that may be sustained due to cancelation of the membership of the Participant, his disqualification from participating in any draws and/or such Participant being held to be ineligible to receive a prize. The campaign running dates and the prize draw date will be communicated separately within each individual campaign. Participants eligible for the recruitment prize draw are only the ones that have met and without exceptions all of the following: • The Participant has to complete the full registration survey • The Participant has to reply to the activation e-mail • The participant has to successfully be activated in our database • The Participant has to be a national of and resident in any of the following countries: Jordan, Palestine, Egypt, Saudi Arabia, UAE, Qatar, Oman, Bahrain, Kuwait, Algeria, Tunisia, Morocco, Libya, Yemen, Djibouti, Syria, Sudan and Iraq. • The Participant has to accept and adhere to all the Terms and Conditions of the site. • The Participant has to be at least 15 years of age. All Participants not adhering with the terms and conditions of 7awi group will not be part of the draw and their account will be subject to deletion without any prior notice. Based on the above criteria Istibyani reserves the right for the selection of final winners for the above mentioned two types of draws by a random selection of the Participant’s ID through Microsoft Excel program. The decision of Istibyani shall be final and no correspondence or discussions shall be entered into. The names of the winners will be published on the Istibyani website. Winners will be notified by phone or e-mail. The prizes shall be delivered directly to the winner, based on the type of rewards given. Cash prizes shall be delivered either through a wired transfer directly to the Participant’s bank account or through a money transfer agency. To make the wired transfer, and only for that reason, the Participant will be asked to provide the full bank account details to deliver the cash reward directly to the Participant’s bank account. It should be noted, however, that in order for the cash reward to be delivered directly to the Participant’s bank account, the relevant bank account must be held with a bank that is located in one of the following countries: Jordan, Palestine, Egypt, Saudi Arabia, UAE, Qatar, Oman, Bahrain, Kuwait, Algeria, Tunisia, Morocco, Libya, Yemen, Djibouti, Syria, Sudan and Iraq. Participants shall be responsible for providing the full correct bank account details. 7awi group shall not be responsible for incorrect bank account details. All bank account information given by Participants is destroyed upon confirmation of receipt of the cash reward from the relevant bank. In case the Participant does not have a bank account, and only at that time, the cash prize will be delivered through a money transfer agency. The Participant shall be provided via email with a number that could be presented at any of the money transfer agency’s branches in the Participant’s country of residence to receive the full prize draw amount converted to the local currency, if such conversion was required by the winner. It should be noted, however, that in order for the cash reward to be delivered to the Participant through a money transfer agency, the branch of the relevant money transfer agency must be located in one of the following countries: Jordan, Palestine, Egypt, Saudi Arabia, UAE, Qatar, Oman, Bahrain, Kuwait, Algeria, Tunisia, Morocco, Libya, Yemen, Djibouti, Syria, Sudan and Iraq. The selected winners will have to provide their full names, address, mobile numbers, and their national ID number in case verification is required by the money transfer agency. Upon receipt of the prize, the winner shall sign the prize receipt acknowledgment form that is sent thereto via email, and shall deliver same to 7awi group Jordan Office following signature. In the event of 7awi group failure to deliver the prize to the winner or inability to contact the winner for any reason whatsoever, during a period of one month and the half from the date on which the names of the winners have been published, it shall select an alternative winner or cancel the prize, as the case may be and without any prior notice.Member Account, Password and Security
Members will receive a password and account designation upon completing the Istibyani registration process. Members shall be fully responsible for maintaining the confidentiality of the password and account, and are fully responsible for all activities that occur under members’ password or account. Members agree to: (a) immediately notify Istibyani of any unauthorized use of members’ password or account or any other breach of security, and (b) exit from members’ account at the end of each session. 7awi group shall not be liable for any loss or damage arising from members’ failure to comply with this section or these entire Terms and Conditions.Links Usage
7awi group assumes no responsibility or liability in respect of the material on any website, or material which members may access through the website, which is not under the control of the 7awi group.Using our Property
The names, logos, icons and graphics used on this website in connection with or identifying the products and/or services of 7awi group (the “Information”) are proprietary marks of 7awi group. Members’ access to the Information does not imply a license to reproduce, transmit and/or distribute the Information in any form or by any means. Members must first obtain the prior written consent of 7awi group.Confidentiality
The Participant agrees to hold in strict confidence and to not disclose to any other parties information learned in connection with any survey, project, questionnaire or other market research activity related to 7awi group.Privacy and E-mail Advertisements
The privacy of personal data is of utmost importance to 7awi group. Please read about this topic in the Privacy Policy. In the event that surveys require personal data to ascertain whether or not the Participant belongs to the target group requested by the Commissioner, no information shall be disclosed to allow the Commissioner to personally identify the Participant. All and any information provided by the Participant in the context of the survey is analyzed and given out in an anonymous form in which the Participant is not identifiable.Termination
Members agree that 7awi group may, under certain circumstances and without prior notice, immediately terminate members’ Istibyani account, and access to the Service. Such circumstances are comprised of the following:(a) breaches or violations of the Terms Of Use or other incorporated agreements or guidelines, (b) requests by law enforcement or other government agencies, (c) a request by members (self-initiated account deletions), (d) discontinuance or material modification to the Service (or any part thereof), (e) unexpected technical or security issues or problems (f) extended periods of inactivity (g) Fraudulent survey completion, and (h) wrong registration information. Termination of members’ Istibyani account includes: (a) removal of access to all offerings within the Service and b) removal of all unclaimed Reward Points to members’ account. Further, members agree that all terminations for cause shall be made in 7awi group’s sole discretion and that 7awi group shall not be liable to members or any third-party for any termination of members’ account, or access to the Service.Legal Effect
If any provision of this notice shall be unlawful, void or unenforceable for any reason, then that provision shall be deemed severable to the extent that it is unlawful, void or enforceable, but shall not affect the validity and enforceability of the remaining provisions. As used in this notice the expression 7awi group shall include its subsidiary and associated companies. This agreement shall be governed by and construed in accordance with the laws of the Hashemite Kingdom of Jordan and is subject to the exclusive jurisdiction of the central courts of Amman (Palace of Justice).
